A Pilot Study on the Design of the ‘Cultural Landscape’ Category in ｢Cultural Heritage Act｣ of Korea 우리나라 ｢문화유산법｣에서 ‘문화경관’ 범주와 세부 유형의 설계

Abstract

This study explored the design and subcategories of the ‘cultural landscape’ category in ｢Cultural Heritage Act｣ of Korea, which came into effect on May 17, 2024. The World Heritage Cultural Landscapes(WHCLs), adopted by the UNESCO in 1992, overcomes the dichotomous perspective that divided world heritage into natural heritage and cultural heritage, and recognizes the combined works of nature and man, that is, heritage containing the interaction between man and nature, as World Heritage. This new type of heritage contributed greatly to the renewal and expansion of the concept of world cultural heritage. The concept of cultural landscape by UNESCO was borrowed precisely from geography. In UNESCO's heritage recognition, the WHCLs made it possible to detect the interface between cultural heritage and natural heritage, the joining point of tangible culture and intangible culture, and the convergence zone of biological diversity and cultural diversity. In contrast, today's Korean ｢Cultural Heritage Act｣ advocates UNESCO's World Heritage system as an international standard, but lacks recognition of the value of the cultural landscape category. Even some cultural landscape-related content that should be dealt with in the Cultural Heritage Act is incorrectly included in the Natural Heritage Act, and there are errors in the expression of key terms. Introducing the cultural landscape category in ｢Cultural Heritage Act｣ will provide an important foundation for rediscovering the uniqueness and diversity of the Korean cultural landscapes in the context of the diversity of world heritages.

이 연구는 2024년 5월 17일 발효된 우리나라 ｢문화유산법｣에서 ‘문화경관’ 범주의 신설 방안과 잠재적 세부 유형들을 탐구한 것이다. 1992년 유네스코 세계유산협의회가 채택한 ‘세계유산 문화경관’(WHCLs)은 인류의 헤리티지를 자연유산과 문화유산으로 양분하던 이분법적 관점을 극복하고 자연과 인간의 합작품, 즉 인간과 자연의 상호작용을 담은 유산을 세계유산의 새로운 유형으로 설정함으로써 세계문화유산 개념의 갱신과 확대에 크게 기여하였다. 이때의 문화경관 개념은 정확히 지리학에서 차용한 것으로, 글로벌 헤리티지를 인식함에 있어서 문화유산과 자연유산의 중간면, 유형문화와 무형문화의 결합면, 생물다양성과 문화다양성의 습합지대를 감지할 수 있게 해주었다. 이와 비교해 오늘날 우리나라 ｢문화유산법｣은 유네스코의 세계유산 체제를 국제 기준으로 표방하면서도 문화경관 범주의 인식이 부재한 실정이다. 심지어 ｢문화유산법｣에서 다루어야 할 문화경관 관련 내용은 ｢자연유산법｣에 잘못 들어가 있고, 일부 용어의 표현상 오류도 있다. 우리나라 ｢문화유산법｣에서 문화경관 범주를 설정하는 일은 글로벌 헤리티지 맥락에서 한국적 문화경관의 고유성과 다양성을 재발견하기 위한 중요한 토대일 것이다.
